The 2018 Agriculture Improvement Act (2018 Farm Bill) approved hemp production and exempted hemp and hemp seeds from the Controlled Substances List by the Drug Enforcement Administration (DEA). It also led the U.S. Department of Agriculture (USDA) to issue regulations and guidance to build a clear regulatory framework across the United States around hemp production. Establishing hemp as a managed commodity also paves the way for U.S. hemp farmers to take part in other farm programs in the USDA.
The USDA’s interim federal rules for hemp production, were released Oct. 31, 2019. They require that only laboratories registered with the U.S. DEA will be qualified to conduct THC testing of hemp crops.
